Adding decking or a patio is one of the most popular ways to get more from your garden. The good news is that most projects do not need planning permission — but there are a few rules worth understanding before you start.
The general rule
In most cases, decking and patios are covered by permitted development rights, meaning no formal planning application is needed. This usually applies as long as the raised platform is no more than 30cm above ground level and, together with other extensions and outbuildings, covers no more than 50% of your garden.
When you may need permission
- Your decking would sit higher than 30cm off the ground
- You live in a listed building or its grounds
- Your property is in a conservation area or Area of Outstanding Natural Beauty
- The structure covers more than half of your garden
- You are creating a raised platform that overlooks neighbours
Building regulations
Ground-level patios rarely involve building regulations, but raised or structural decking may need to meet safety standards for load and railings. A professional installer will build to the correct standard and advise you if any approvals are required.
